Who is responsiblte for vehicle damage that results from an unmarked road hazard?

For example, I did several hundred dollars damage to my suspension when I hit a severe dip in the road. I was going the speed limit, and there were no signs. Last night, I did another several hundred dollars damage to my tires and rims when I hit a curb that was installed in the middle of the road with no markings or lighting. The tow truck operator told me that tons of people are hitting the curb and requiring tows. Who's responsible?

  1. Go after the city.. they are not doing their job properly and as a result to this they are costing you money. We have a big pothole issue in my town and if you can prove that the damage to your car was the result of the city's negligence then they will pay for your damages. Good luck!!!
  2. If your car is not capable of navigating an undamaged road at posted speed limits without sustaining physical damage, whose responsibility is that? Unless you can prove that the road is substandard or that the local government is delinquent on maintenance, you don't have a case when it comes to the dip in the road. As far as the curb goes, was it in your lane? If not, why weren't you?
  3. Unfortunately if you have your Insurance company fix your car its going to be a negligent accident on your record. Your collision coverage will fix your car. As far is going to the city to get compensation, I don't know, but it's worth a try!
